Tax Positions, Potential Penalties and Tax Shelter Disclosure Requirements
Because thetax law is not always clear, My Tax Genii will use its professional judgment in assisting you to resolvequestions affecting your returns. Your returns may be selected for review by taxing authorities, who may not agree with your positions. Any adjustments they propose are subject to certainrights of appeal. In that event, My Tax Genii would generally be pleased to represent you for anadditional fee. Because of the lack of clarity in the law, however, My Tax Genii cannot provide assurance that the positions asserted by taxing authorities will not ultimately be sustained. Youshould note that the tax law currently provides for a 20 percent penalty that applies to any“substantial understatement” of tax liability which is defined as the greater of 10 percent of thetax required to be shown on the return or $5,000.
The IRS and some states have promulgated “tax shelter” rules that require taxpayers to disclosetheir participation in “reportable transactions” by attaching a disclosure form to their federaland/or state income tax returns and, when necessary, by filing a copy with the Internal RevenueService and/or the applicable state agency. These rules impose significant requirements todisclose transactions and such disclosures may encompass many transactions entered into in thenormal course of business or in your personal investing activities. Failure to make suchdisclosures could result in substantial penalties. You are responsible for ensuring that you haveproperly disclosed all “reportable transactions.” My Tax Genii will not be liable for any penaltiesresulting from your failure to accurately or timely file any required disclosure. Please note that any disclosure required by or made pursuant to the tax shelter rules is separate and distinct from any other disclosure that you might be required or choose to make with your tax returns. My Tax Genii’s ability to identify transactions requiring disclosure is limited to the information that you provide as part of the tax return preparation process. In this connection, you should note that My Tax Genii cannot take responsibility for identification of potentially disclosable transactions that originatefrom pass-through entities (partnerships, S Corporations, LLC’s, etc.) when the relevant facts arenot disclosed by the pass-through entity’s tax reporting information that you are responsible tosupply to us. Further, our procedures will not include inquiries of the pass-through entities toascertain the existence of potentially disclosable transactions unless you specifically request suchservices from us in writing.
